These Terms of Service (“Terms”) govern your access to and use of the Allhart Web Design website (allhart.com.au) and the services Allhart Australian Enterprises Pty Ltd (“Allhart”, “we”, “us”) provides through it. By using the site or engaging us for a service, you agree to these Terms.

1. Who we are

Allhart Web Design is the trading name for Allhart Australian Enterprises Pty Ltd, an Australian company based in Brisbane, Queensland. We design websites, run AI audits, and consult on AI implementation for small to mid-sized businesses, primarily in Australia.

2. Use of the website

You may browse this site, submit forms, and download resources we make available. You agree not to use the site to:

  • Submit false or misleading information
  • Scrape, mirror, or republish our content without permission
  • Interfere with the operation of the site or its underlying infrastructure
  • Use automated tools to bulk-submit forms

3. Engagements and contracts

If you engage us for a paid service (website build, AI audit, consulting), the specific scope, deliverables, fees, and timeline will be set out in a separate written agreement or invoice. These Terms apply alongside that agreement; if there is a conflict, the engagement-specific agreement prevails.

4. Intellectual property

All site content (text, images, code, brand assets) is owned by Allhart or licensed to us. You may not reproduce or republish it without permission. Where we deliver work for a client, ownership and licensing are governed by the relevant engagement agreement.

5. Third-party services and APIs

Where Allhart connects to third-party services on your behalf (including Google APIs and YouTube API Services for the upload-publishing service), your use is also subject to those providers’ terms:

6. No professional advice

Material on this site (blog posts, audit summaries, case studies) is general information about how we approach our work. It is not legal, financial, or specific business advice for your situation. Engage us under a written agreement for advice tailored to your business.

7. Liability and Australian Consumer Law

Nothing in these Terms excludes, restricts, or modifies any consumer guarantee, right, or remedy under the Australian Consumer Law (Schedule 2 of the Competition and Consumer Act 2010) that cannot lawfully be excluded. To the extent permitted by law, Allhart’s aggregate liability for any claim arising from your use of the site is limited to AUD $100. We are not liable for indirect, special, or consequential losses.

8. Privacy

Use of this site is also governed by our Privacy Policy, which explains what information we collect and how we use it.

9. Changes to these Terms

We may update these Terms from time to time. The “last updated” date at the top reflects the most recent revision. Continued use of the site after a change means you accept the updated Terms.

10. Governing law

These Terms are governed by the laws of Queensland, Australia, and the courts of Queensland have non-exclusive jurisdiction over any dispute.
